Please read these Terms & Conditions carefully before using our website or booking any services. By accessing our website or making a reservation, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. About Us
Casta Tours is a trading name of Zebra Boemia, Lda, a company registered in Portugal (Tax ID: 514074950), with its registered office at Rua de Chousais, 258, 4625-391 Marco de Canaveses, Portugal. We operate private guided tours throughout Northern Portugal, including Porto, the Douro Valley, and the Vinho Verde region.
2. Bookings & Reservations
- All bookings are requests subject to availability and require written confirmation from Casta Tours to constitute a binding contract.
- A booking is confirmed once you receive a written confirmation (via email) and any required deposit or payment has been processed.
- It is your responsibility to ensure that all information provided at the time of booking (names, dates, group size, special requirements) is accurate and complete.
- Prices are quoted in Euros (EUR) and include VAT where applicable. Prices are subject to change until a booking is confirmed.
- Depending on the tour, full payment or a deposit may be required at the time of booking, with any remaining balance due before the tour date as specified in the confirmation.
3. Cancellation & Refund Policy
Cancellations by the client:
- More than 7 days before the tour — full refund, minus any non-recoverable third-party costs (e.g., pre-purchased tickets or reservations).
- 3 to 7 days before the tour — 50% refund of the total booking value.
- Less than 3 days before the tour or no-show — no refund.
Cancellations by Casta Tours:
- If we cancel a tour for reasons within our control, you will receive a full refund or the option to reschedule at no additional cost.
- If a tour must be modified due to circumstances beyond our control (e.g., venue closures, road conditions), we will offer a suitable alternative or a partial refund as appropriate.
All cancellation requests must be submitted in writing to [email protected]. The cancellation date is the date we receive your written notice.
4. Tour Modifications & Itinerary Changes
- Tour itineraries are indicative and may be subject to change due to weather, traffic, local events, venue availability, or other factors outside our control.
- We reserve the right to modify the route, order of stops, or included venues, provided the overall quality and nature of the experience are maintained.
- Where a significant change is necessary, we will inform you as soon as possible and offer alternatives when available.
5. Participant Responsibilities
- Participants must be punctual at the agreed meeting point. Late arrivals may result in a shortened tour without entitlement to a refund.
- You are responsible for ensuring you have adequate travel and health insurance for the duration of your trip. Casta Tours does not provide personal travel insurance.
- Some tours involve walking on uneven terrain, cobblestones, or steps. Please inform us of any mobility limitations or health conditions at the time of booking so we can accommodate your needs.
- Participants are expected to behave respectfully toward guides, local communities, and fellow guests. We reserve the right to end a tour without refund if a participant's conduct endangers the safety or well-being of others.
- The minimum age to book independently is 18 years. Minors are welcome on tours when accompanied by a responsible adult.
6. Alcohol & Wine Tastings
Several of our tours include wine tastings. Participants must be of legal drinking age (18 years in Portugal). Alcohol consumption is at your own discretion and responsibility. We encourage responsible enjoyment. We reserve the right to limit or refuse service of alcohol if we deem it necessary for safety reasons.
7. Force Majeure
Casta Tours is not liable for failure or delay in performing our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to: natural disasters, extreme weather, pandemics, government actions, strikes, civil unrest, or transport disruptions. In such events, we will work with you to reschedule or provide a credit for future use.
8. Liability
- Casta Tours takes all reasonable measures to ensure the safety and quality of our tours. However, participation in tours is at your own risk.
- We are not liable for any loss, damage, injury, or expense arising from circumstances beyond our control, your own actions, or those of third parties not connected to our services.
- Our total liability for any claim arising from or related to a booking shall not exceed the total amount paid for that booking.
- Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
9. Intellectual Property
All content on the Casta Tours website — including text, photographs, videos, logos, graphics, and design — is the property of Zebra Boemia, Lda or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any materials without our prior written consent.
10. Photography & Media
Our guides may take photographs or videos during tours for promotional purposes. By participating in a tour, you consent to the use of such images unless you inform us otherwise before the tour begins. If you prefer not to be photographed, please notify your guide at the start of the experience.
11. Website Use
- The information on our website is provided for general informational purposes and is subject to change without notice.
- You agree not to use the website for any unlawful purpose, or in a way that could damage, disable, or impair the site's functionality.
- We are not responsible for the content of external websites linked from our site.
12. Privacy & Data Protection
Your personal data is collected and processed in accordance with our Privacy Policy and applicable data protection legislation, including the GDPR. By making a booking, you acknowledge that you have read and understood our Privacy Policy.
13. Complaints
We are committed to delivering exceptional experiences. If something does not meet your expectations, please raise it with your guide during the tour so we can address it immediately. For formal complaints after the tour, please contact us in writing at [email protected] within 14 days of the tour date. We will acknowledge receipt within 5 business days and aim to resolve the matter within 30 days.
14. Governing Law & Jurisdiction
These Terms & Conditions are governed by and construed in accordance with the laws of Portugal. Any disputes arising from or in connection with these terms or our services shall be subject to the exclusive jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer protection rights under EU or national law.
15. Changes to These Terms
We reserve the right to update these Terms & Conditions at any time. The revised version will be published on this page with an updated "Last Updated" date. Changes do not apply retroactively to bookings already confirmed. We encourage you to review this page periodically.
